LEGAL
Terms of Use
1. About Qalb and these Terms
Qalb is an Islamic journaling and AI-assisted reflection app operated by Ilmara Group LLC, a United States company. In these Terms, "Qalb," "we," "us," and "our" refer to Ilmara Group LLC.
These Terms explain the Qalb service and the conditions for using it.
Your licence to use the iOS application is governed by Apple's Licensed Application End User License Agreement. These Terms supplement that agreement with information about Qalb's services. They do not replace Apple's Standard EULA. If there is a conflict concerning the application licence, Apple's Standard EULA governs, subject to applicable mandatory law.
Qalb is intended for adults aged 18 and older.
2. AI-assisted reflection and guidance
Qalb uses AI to support journaling, generate reflections and journal metadata, and help connect entries with Qur'anic guidance.
AI-generated content can be inaccurate, incomplete, or unsuitable for your circumstances. This includes how religious sources are selected, explained, or applied to an individual situation. Do not treat an AI-generated reflection as a definitive religious ruling or a statement of what Allah intends for you.
Qalb provides tools for personal reflection and general information. It does not provide medical care, mental-health treatment, diagnosis, legal advice, or authoritative religious rulings. Seek an appropriately qualified professional or religious scholar when you need advice specific to your circumstances.
Qalb is not an emergency service and does not continuously monitor journal entries. Do not rely on Qalb to identify every safety concern or to arrange help. If you or someone else is in immediate danger, contact local emergency services.
Before journal content is first sent for AI processing, Qalb asks you to review and affirmatively accept its AI-processing disclosure. AI-dependent features require that processing permission.
You can withdraw permission for future AI processing in Settings. Doing so stops future AI-dependent processing but does not reverse processing that has already occurred. Our Privacy Policy explains the relevant data practices and retention arrangements.
Accepting these Terms does not, by itself, constitute consent to AI processing or marketing communications.
3. Your journal and other content
You retain any ownership and intellectual-property rights you have in your journal entries and other original content you provide. Qalb does not claim ownership of your writing.
When you request a feature that requires processing your content, Qalb and its service providers process the information needed to provide that feature, as explained in the Privacy Policy and any applicable consent disclosure.
These Terms do not grant Qalb permission to publish your private journal, use it in advertising, or use it for unrelated purposes.
Qalb's software, branding, design, and other materials remain the property of Ilmara Group LLC or their respective owners. Third-party translations, commentary, audio, and other materials may have separate intellectual-property protections.
4. Local storage, export, and deletion
Qalb stores journal history, drafts, and saved reflections locally on your device. Qalb does not operate a general cloud archive or backup of your journal history.
Local storage does not mean that journal text never leaves your device. When you enable and use AI features, the information needed for those features is transmitted for processing as described in the Privacy Policy.
Deleting an entry, using Delete My Data, uninstalling Qalb, resetting your device, or losing access to your device may result in permanent loss of locally stored information. Device-level backups may behave differently, and Qalb does not control those backup services.
You can use Settings → Privacy → Export My Data to create a JSON file containing locally stored journal information and available Qalb profile information. The file is generated on your device. Exporting does not automatically back up future entries, and an export file does not by itself provide an in-app import or restore feature.
Export files may contain sensitive information. Choose carefully where you save or share them.
Qalb cannot recover journal content for which it does not hold a copy. This explanation does not limit any responsibility or remedy that cannot lawfully be excluded.
Deleting Qalb or its data does not automatically cancel an App Store subscription.
5. Subscriptions, trials, cancellation, and refunds
Qalb offers paid subscriptions through Apple's App Store. The available plans, included features, billing periods, and prices are displayed before you confirm a purchase. Prices and offers may vary by country or region.
Apple bills your Apple Account using the payment method associated with that account. Subscriptions automatically renew for the applicable billing period unless cancelled through Apple.
Where a free trial or introductory offer is available, its duration, eligibility conditions, and the price payable afterward are shown before you subscribe. Unless cancelled in time, the subscription converts to a paid subscription at the price and billing interval shown when you accepted the offer.
To avoid an upcoming renewal charge, cancel before the renewal deadline shown by Apple. Apple advises cancelling free or discounted trials at least 24 hours before the trial ends.
You can manage or cancel your subscription through your Apple Account subscription settings. On an iPhone, this is generally:
Settings → your name → Subscriptions → Qalb.
Cancelling renewal and requesting a refund are separate actions. For purchases billed by Apple, you can request a refund through Apple's refund process.
Refund eligibility is subject to Apple's applicable purchase terms and your rights under applicable law. Nothing in these Terms removes a statutory right to cancellation, withdrawal, a refund, or another remedy.
Uninstalling Qalb, deleting your Qalb data, withdrawing AI consent, or unsubscribing from marketing emails does not cancel your Apple subscription. Please manage the subscription separately through Apple.
Any subscription price change will follow Apple's applicable notification and consent processes and applicable law.
6. Responsible use
You must not misuse Qalb by attempting to access another person's information, interfere with the service, introduce malicious code, circumvent security, safety, or payment controls, or use the service in a way that infringes another person's rights or violates applicable law.
You must not deliberately use Qalb's AI features to facilitate unlawful activity, harm, exploitation, fraud, harassment, or other abusive conduct, or attempt to circumvent safeguards designed to prevent such misuse.
Qalb may apply technical request limits, safety measures, and abuse-prevention controls to protect users and the service. Certain AI requests may be limited or declined where necessary to apply these safeguards.
Writing honestly about distress, difficult experiences, personal struggles, intrusive thoughts, or other sensitive topics is not, by itself, misuse of Qalb. A decision by Qalb not to provide an AI-generated response does not, by itself, mean that you have violated these Terms.
7. Service availability and changes
AI features require an internet connection and depend on Qalb's infrastructure and third-party services. They may sometimes be unavailable because of maintenance, technical problems, or service interruptions.
We may make reasonable changes to maintain security, comply with law, resolve technical issues, or improve the service. Material changes affecting a paid service will be handled with appropriate notice and any cancellation or other remedies required by law.
We may restrict access where reasonably necessary to address a material breach of these Terms, protect users or the service, or comply with law. Where appropriate and lawful, we will explain the reason and provide an opportunity to resolve the issue.
These provisions do not remove your rights relating to services you have paid for.
8. Privacy and communications
Our Privacy Policy explains what information Qalb processes, the providers involved, retention, international processing, and your privacy choices and rights.
Privacy requests can be sent to salam@theqalb.app. The Privacy Policy also provides contact details for our appointed EU and UK representatives.
Marketing preferences are separate from accepting these Terms and from enabling AI processing.
9. Your legal rights
We will provide Qalb with reasonable care and skill. We do not promise that using Qalb will produce a particular emotional, spiritual, health, or other personal outcome.
Nothing in these Terms excludes or limits rights, warranties, remedies, or responsibilities that cannot lawfully be excluded or limited. This includes applicable rights concerning digital content and services, cancellation, refunds, and remedies for a service that does not meet legal requirements.
Nothing in these Terms excludes liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that applicable law does not allow us to exclude.
Any applicable mandatory consumer protections take precedence over conflicting wording in these Terms or an incorporated agreement.
You may contact us about a concern or complaint at salam@theqalb.app. Doing so does not prevent you from exercising any other legal rights.
10. Changes to these Terms
We may update these Terms to reflect changes to Qalb, legal requirements, or the way the service is provided.
We will update the date above and provide appropriate notice of material changes. Where the law requires your agreement to a change, we will obtain it before applying that change.
Updates will not retrospectively remove rights that have already arisen.
